Client COntract
TL;DR Adjustments take time
PROCESS:
Considering the mixed media nature of my work, even minor adjustments require a significant amount of time and energy. Therefore, I respectfully request that clients have their inspiration and necessary information prepared in advance (with some exceptions), to ensure the project progresses efficiently without unnecessary delays. Additionally, clients should expect at least one business day between major changes, although there may be special exceptions to this guideline depending on the project's specifics and urgency. Please note that after the initial two major revisions, an additional fee of $100 will be charged for each subsequent major revision to accommodate the extra time and resources required.
This policy is implemented not just to manage the project timeline effectively, but also to encourage clear and decisive communication from the outset. It ensures that both parties are aligned on the vision and scope of the project, minimizing the need for extensive revisions later on. I am committed to delivering high-quality work that meets your expectations, and this collaborative approach helps achieve that goal while respecting the intricacies involved in creating mixed media art.
FILES:
I typically do not share the layered PSD files of our projects, unless we have agreed upon it in advance or it has been explicitly stated. This approach helps protect the copyright and integrity of the work.
If you need access to these files, please let me know. We can discuss the possibility and make arrangements if necessary.
APPROACH:
My work, deeply rooted in the nuances of mixed media, carries with it a level of unpredictability. Certain images may not always align with the expected effects due to the dynamic nature of the materials and techniques involved. This unpredictability is a core aspect of mixed media art, leading to outcomes that are unique and, at times, surprising.
Acknowledging this, I encourage clients to approach their projects with flexibility and an open mind. While I endeavor to bring your vision to life, the inherent characteristics of mixed media might lead to variations from our initial plans. Such variations can often enrich the artwork, adding layers of complexity and interest.
For a successful collaboration, it's important that clients come prepared with clear ideas and be ready to adapt as the project evolves. Open and ongoing communication is key to managing expectations and ensuring that the final piece reflects a harmonious blend of our shared vision and the spontaneous nature of mixed media. This collaborative spirit allows us to produce artwork that resonates with both the artist's and the client's aspirations.
RIGHTS OF USAGE:
Upon completion of the project and full payment, the Client will obtain the rights to use the final artwork (the "Work") for the purposes agreed upon in this contract. The Designer retains all intellectual property rights to the Work, including but not limited to the right to use initial sketches, drafts, and final artwork for portfolio purposes, exhibitions, and promotional activities, unless otherwise agreed upon in writing.
The Client may not use the preliminary designs or drafts not selected as the final artwork without obtaining written permission from the Designer. Such use may incur additional fees. The Designer grants the Client a non-exclusive, non-transferable license to use the final Work in the agreed-upon manner. Any additional uses not outlined in this agreement require negotiation for a separate license and may be subject to additional fees.
This section ensures that while the Client can fully enjoy and utilize the final Work for its intended purpose, the Designer's creativity and intellectual property are protected, allowing for mutual respect and acknowledgment of each party's contributions and rights.
